Settlement for woman who underwent mastectomy after delayed Paget's disease diagnosis

Following admission of liability by Trust Primary Care Limited, Lindsay Holt secured settlement at mediation of £475,000 for a woman who had to undergo a total left mastectomy because clear signs she was suffering Paget's disease were missed for years.

The mastectomy, chemotherapy and axillary node removal she underwent would all have been avoided with a timely diagnosis. On top of this, she was unable to embark on planned fertility treatment and lost the opportunity for successful IVF by the time she could proceed with treatment.

She also suffered significant side effects from adjuvant treatment, lymphoedema and had to give up work due to her symptoms prior to diagnosis.  These included fatigue, depression and anxiety and loss of confidence which affected her prospects of ever returning to work.

Despite the admission of breach of duty by the defendant, causation of the substantive injuries was disputed. The defendant agreed to make a substantial interim payment and, the parties then agreed to exchange evidence and mediation. The matter later settled at mediation.
