Settlement for unwanted fifth pregnancy following failed sterilisation

Paul McNeil pursued an obstetrics negligence claim for Emily following a failed sterilisation during a Caesarean section, which resulted in an unwanted pregnancy and depression.

Emily's fourth child was to be delivered by Caesarean section (her third caesarean). At the same time, Emily expressed a wish that she be sterilised.

This plan was confirmed by her obstetrician and was documented in her notes. The discharge summary sent to Emily's GP confirmed that she had undergone a caesarean and sterilisation.

The sterilisation was not carried out although Emily was not aware and she became pregnant again, as a result of which she suffered from depression. Following the birth of her fifth child, Emily was sterilised.

We settled the claim in the sum of £15,000, plus costs.
