Settlement for teenager badly affected by terrible road rage collision

Jack Sales has secured settlement for his client Tom* who was injured when a car he was a front seat passenger in careered off the road.

Tom was one of three teenagers being driven along a country lane in Kent by an older friend who had taken cocaine and cannabis.

The driver had seen his ex-girlfriend on the road with another man and made several risky manoeuvres to taunt the pair before he lost control of the car. The vehicle crashed into a tree and then flipped onto its roof.

Tom was taken to Kings College hospital by ambulance and the driver was arrested and later prosecuted. The driver was found guilty of causing serious injury by dangerous driving and handed a years' sentence in a young offender's institute.

Tom was an athletic 16-year-old at the time of the crash, a mixed martial arts enthusiast and extremely fit. In the accident he suffered several fractures to his arms, scarring and injuries to his face and legs. He had surgery for his injuries, requiring metalwork, and spent five days in hospital.

Since the accident he has not been able to resume MMA training and has been left with severe post traumatic stress disorder from the crash.

Jack acted for Tom and another of the young passengers, and successfully settled both claims against the driver's motor insurer. The company voided the policy as the driver had taken drugs, and so Jack issued proceedings against both parties and negotiated a settlement.

Since the accident Tom has experienced severe anxiety that affects his daily life. Prior to the crash he worked part-time doing manual labour alongside his college studies but could not returned to this due to weakness and pain in his arm. Jack secured interim damages to fund a course of psychological treatment.

The settlement secured buy Jack will help to fund further treatment and allow Tom to get his life back on track.

Thanking Jack for his work, Tom's mother said: "From our first meeting you’ve been so easy to work with and just “got” Tom. I have always said we would be guided by you and that we have."
